Terms of Service

These Terms of Service ("Terms") govern your use of the Kollektify website and services. By using Kollektify, you agree to these Terms.

1. The service

Kollektify is a personalized digital gifting platform. We create AI-generated songs, cover art, and e-cards ("Digital Gift Products") for personal and group occasions. All Digital Gift Products include a personalized gift page where friends and family can add messages to create a memorable group greeting for the recipient. Some functionality depends on third-party providers.

2. Accounts and eligibility

  • You must provide accurate information and keep access links/credentials secure.
  • You are responsible for activity under your account or access link.

3. User content

You may upload content to Kollektify, including text messages, images, photos, videos, and prompts ("User Content"). You represent and warrant that you own or have all necessary rights, licenses, and permissions to share any User Content you upload, and that it does not violate any applicable law or third-party rights (including intellectual property, privacy, and publicity rights).

You grant Kollektify a non-exclusive, worldwide, royalty-free license to host, store, process, display, reproduce, and distribute your User Content solely for the purpose of operating, providing, and improving the service. This license continues until the content is deleted from our systems.

You are solely responsible for any User Content you upload. Kollektify does not endorse, verify, or assume any liability for User Content posted by users. By uploading content, you accept full responsibility for its legality, accuracy, and appropriateness.

3a. Content moderation and removal

Kollektify is not obligated to monitor, review, or moderate User Content. However, we reserve the right (but not the obligation) to review, screen, edit, refuse to post, or remove any User Content at our sole discretion, at any time, and for any reason, including but not limited to content that we believe:

  • Violates these Terms, including the Prohibited Use section below;
  • Is offensive, harmful, objectionable, inaccurate, or otherwise inappropriate;
  • May expose Kollektify, our users, or any third party to harm or liability;
  • Violates the privacy or intellectual property rights of any third party.

We may also suspend or terminate access for any user who repeatedly or egregiously violates these Terms. Removal of content or termination of access does not entitle the user to any refund.

If you become aware of any User Content that you believe violates these Terms or is otherwise inappropriate, please contact us at support@kollektify.com. We will review reports in good faith, but we are not obligated to act on every report.

4. Payments, gift purchases, and gift options

  • Payments for Digital Gift Products are processed by Stripe.
  • Guests can purchase personalized add-ons to enhance the gift experience for the recipient. Individual gift purchases are subject to a per-transaction limit. Total purchases per gift are capped based on the product tier.
  • Premium gift tiers include a digital gift card as a bonus, delivered directly to the recipient alongside their personalized AI song. Recipients can redeem their included gift card through our fulfillment partners, subject to their terms. Recipients have 365 days from delivery to redeem their gift card.
  • A small processing fee is applied to each purchase to cover payment processing and fraud prevention costs. This fee is clearly displayed before each purchase is confirmed.
  • Refunds: If a gift is cancelled before delivery, all payments are automatically refunded minus applicable processing fees. Once a gift has been delivered to the recipient, payments cannot be refunded.

5. Prohibited use

You agree not to use Kollektify to:

  • Engage in any illegal, harmful, or fraudulent activity;
  • Upload, share, or distribute content that is defamatory, obscene, pornographic, sexually explicit, or exploitative — including any content depicting or promoting child sexual abuse material (CSAM);
  • Upload content that promotes violence, harassment, bullying, intimidation, hate speech, or discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or age;
  • Upload content that infringes any copyright, trademark, trade secret, or other intellectual property or proprietary rights of any third party;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Upload content that contains malware, viruses, or any other harmful code;
  • Use the service for unsolicited advertising, spam, or commercial solicitation;
  • Attempt to disrupt, reverse-engineer, decompile, or otherwise compromise the service or its infrastructure.

Violation of any of these prohibitions may result in the removal of your content, a formal warning, suspension, or permanent termination of your access to the service, at our sole discretion.

6. Third-party services

Kollektify integrates with third-party services (payments, fulfillment, analytics, AI generation). Their terms and privacy policies may apply. We are not responsible for third-party services outside our control.

7. Disclaimers

The service is provided "as is" and "as available". We don't guarantee uninterrupted operation or that generated content will always meet your expectations.

8. Limitation of liability

To the maximum extent permitted by law, Kollektify will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kollektify, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the service;
  • Any User Content you upload, post, or share through the service;
  • Your violation of these Terms;
  • Your violation of any applicable law or the rights of any third party.

10. Copyright and intellectual property

If you believe that any User Content on Kollektify infringes your copyright or other intellectual property rights, please notify us at support@kollektify.com with the following information:

  • A description of the copyrighted work you claim has been infringed;
  • The URL or location of the allegedly infringing content on Kollektify;
  • Your contact information (name, email, phone number);
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We will review and respond to valid copyright notices in accordance with applicable law.

11. Changes

We may update these Terms from time to time. Continued use of the service after an update means you accept the revised Terms.
